Terms of Service

Short version: Use GetOutpulse for legitimate business outreach. Don't spam. Honour unsubscribes. You own your data. We provide the tool as-is. AppSumo lifetime licenses are for one organisation, non-transferable.
1. Acceptance of Terms
By installing, accessing, or using GetOutpulse (the "Software"), you ("User", "you") agree to be bound by these Terms of Service ("Terms") and all policies incorporated by reference, including the Privacy Policy and Acceptable Use Policy.
If you are using GetOutpulse on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
If you do not agree, do not use the Software.
2. Who We Are
GetOutpulse is developed and licensed by Loans Got Easy Inc., a corporation registered in Alberta, Canada ("we", "us", "Company"). For questions: [email protected].
3. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use the Software for your own internal business purposes.
AppSumo Lifetime Deal: Licenses purchased through AppSumo are perpetual for the tier purchased. Each license covers one organisation (one company or individual). Lifetime licenses may not be resold, transferred, shared across unrelated businesses, or used as a multi-tenant platform to serve third parties without a separate Agency license agreement.
Source code: The Software may include open-source components under their respective licenses. Proprietary portions may not be reverse-engineered, decompiled, or redistributed without written permission.
4. Acceptable Use
You must comply with our Acceptable Use Policy at all times. In summary: you may not use GetOutpulse to send spam, harass anyone, violate email regulations (CAN-SPAM, CASL, GDPR), or engage in any illegal activity.
Violation of the AUP may result in immediate license revocation without refund.
5. Your Data and Content
You own all data you enter into GetOutpulse — contacts, email copy, campaign data, and API credentials. We claim no rights to your data.
Because GetOutpulse is self-hosted, we have no access to your data. You are solely responsible for:
- The contacts you upload and their accuracy
- The content of emails you send
- Compliance with email regulations in your jurisdiction
- Honouring unsubscribe requests within the legally required timeframe
- Backing up your database file
6. Third-Party Integrations
GetOutpulse connects to third-party services (Apollo, Brevo, HubSpot, etc.) using API keys you provide. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or legal compliance of third-party data sources.
You are responsible for obtaining and maintaining valid licenses and API keys for any third-party services you use through GetOutpulse.
7. Payments and Refunds
AppSumo purchases: Purchases made through AppSumo are governed by AppSumo's refund policy (60-day money-back guarantee). Refund requests must be submitted through AppSumo, not directly to us.
Direct purchases: If purchased directly, we offer a 30-day money-back guarantee for first-time purchases. Refunds are not available for renewals or after 30 days.
Refunds are not available if a license has been revoked for AUP violations.
8. Updates and Support
We aim to provide updates that improve functionality and security. Updates are not guaranteed on any schedule. Lifetime deal holders receive updates for the major version purchased plus one major version upgrade.
Support is provided via email at [email protected] and through the documentation at getoutpulse.com/docs. We aim to respond to support requests within 2 business days.
9. Disclaimer of Warranties
The Software is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- Emails sent through GetOutpulse will be delivered or not marked as spam
- Data from third-party sources is accurate, complete, or legally compliant
- The Software will operate uninterrupted or error-free
- Using GetOutpulse will result in any particular business outcome
10. Limitation of Liability
To the maximum extent permitted by law, Loans Got Easy Inc. and its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, goodwill, data, or business opportunities — arising from your use of or inability to use the Software, even if advised of the possibility of such damages.
Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid for the Software in the twelve months preceding the claim, or CAD $100, whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless Loans Got Easy Inc. from any claims, damages, fines, or expenses (including legal fees) arising from: (a) your use of the Software; (b) emails you send using GetOutpulse; (c) your violation of these Terms or applicable law; (d) any claim that your use of the Software infringed a third party's rights.
12. Termination
You may stop using GetOutpulse at any time by uninstalling the Software and deleting your database file.
We may revoke your license immediately and without notice if you violate these Terms or the Acceptable Use Policy. Upon termination, you must cease all use of the Software. No refund is due for terminations caused by your breach.
13. Governing Law and Disputes
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
Any dispute arising from these Terms shall first be addressed by good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Calgary, Alberta, Canada, under the Arbitration Act (Alberta). Either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
14. Changes to These Terms
We may update these Terms from time to time. We will post the updated version at this URL with a new effective date. Your continued use of the Software after the effective date constitutes acceptance of the revised Terms. For material changes, we will provide notice via the application or email if we have your contact details.
15. General
If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. Our failure to enforce any right or provision does not constitute a waiver. These Terms, together with the Privacy Policy and AUP, constitute the entire agreement between you and us regarding the Software.
